I just stood up for my legal rights at work the other night. The place where I work is the most unsecure place on the planet. A wide open field has more security than my workplace. Only one guard for the entire plant and he's only at the front entrance. There are about 20 other doors that should really only be used for emergency but are left unlocked with no alarms on them so anyone can come in and out totally undetected at any time of the night. They also seem to love storing their inventory OUTSIDE in the PARKING LOT!
And they wonder why things get stolen. Apparently the other night someone stole a bunch of tools, from what I hear. So when it was time for my break on Thursday night I got in my truck to go to the store. I get stopped by the guard who has a line of two cars already pulled off to the side of the parking lot. I see him look in the other guy's windows and the dude pops his trunk and the guard looks in it!
I thought to myself, "NO way is he searching my vehicle." Hell, COPS have no legal right to search your vehicle unless they have 1) Probably Cause 2) Permission from you or 3) A search warrent.
So he comes up to my truck. I roll down my windows and say, "What's up?"
He says, "Do you have a dome light?"
I said, "Yup. I sure do."
"Can you turn it on for me?"
"Nope."
"Why not?"
"Why do you want me to turn on my dome light?"
"I need to search everyone's car as they leave to make sure they're not stealing anything."
"Well, I happen to know that even the POLICE don't have the right to search anyone's vehicle unless they have probable cause, permission or a search warrent. So if you suspect that I am stealing stuff then I suggest you have a meeting with HR, have them call the police and have them get a warrent. Otherwise you have no reason to search my vehicle and you do not have my permission. Now excuse me. I'm on break and am in a little bit of a hurry."
I pulled away from him and the other line of cars and there was nothing he could really do to begin with. I later talked with him and he said he hates having to do this and I told him it was nothing personal but he is actually violating people's personal rights by doing so. He's just lucky that people are giving up their rights to be searched by someone who lacks the authority to really do it to begin with. I told him that he doesn't really know me very well but I don't give up my rights for anything.
The next day the same guard and another one were at the entrance and when they saw me coming they didn't try to stop me. It's always an adventure in Itallian Land.

I know he wasn't attacking me personally but he was asking me to submit to an illegal search. No one has the right to invade your privacy. I have read up on the 4th ammendment and understand the plain view clause. But if he can't see in to the truck without the dome light it's not in plain view. And he certainly wouldn't be searching through my truck box. I didn't say everyone was happy with everything I post. I just think its funny how he is always angry and going off like a know it all. I have a criminal justice degree and I work at a Police Station. I'm not trying to say I know it all but the rules of evidence are pretty universal, but they do differ that is why I suggested he check his state statue. And I hope we are a better bunch of people than the type to start with racial slurs when we are angered by something. I'm sure Harold wouldn't like his board degrading to that. I simply asked him to take it else where. Harold has said he wanted a "Family friendly" board and I don't think blaming someones race for their actions friendly. There are trashy people of all ages, races, genders, etc. We have started fresh since the removal of the private forumn and I don't think we need to start fighting again. And on the issue of how often I post, its up to you if you want to read it or not. Post count doesn't mean as much as it did at the place you profess to hate. edit: Does my multiple posting make it okay for people to act like bigots? 2ND EDIT:I'm at work so I have to read posts fast. I just reread your post. In it you say some of you almost left last time I did this??? I thought we were starting fresh. And as far as doing anything. I haven't done anything besides ask for the racist crap to stop. If a bunch of you want to be a bunch of bigots I say "don't let the door hit you where the good lord split you"

What is the problem with Wesley posting here about the inanity of illegal searches at his job? Why create a thread where you have the ability to post something crazy if in fact you can't. Oh I know, just Wesley can't open his mouth for fear he may scare someone off. What he may have said could help someone else out that has a right to say "no" and doesn't know their 4th Amendment rights. Last time I looked, the Bill of Rights didn't apply just to certain states, but to Americans as a whole. I am sure that his employee handbook doesn't say he will be forced into occasional searches from time to time because he might be suspected of stealing. Why would he want to let some average joe in a uniform that makes $7 an hour go through his personal belongings? This person may come back and break into his vehicle or anyone else's who was dumb enough to give in. This is one of the problems with this country is that everyone is intimidated into doing things they legally do not have to do. People are uneducated about it therefore they give into every person showing or claiming to show authority because they are scared. As far as Wesley being angry all the time and a racist? You don't know him very well, obviously, and are actually judging him. He just doesn't let people pull the wool over his eyes nor does he take crap from anyone no matter who they are or where they are from. Why is it that when people stand up for themselves and don't bow down, they are automatically thought of as an a$$hole? He's heard it all before as have I so it doesn't matter. If it ruins friendships, oh well.
This is one of the main reasons WHY I don't bother myself with messageboards and this will be the last post that I make here. I thought this place would be different than it is with how people treat others, but it's not. People want other people to post and as soon as they do, they are shot down because of what they decide to talk about. The sooner people realize that everyone is not the same as everyone else when it comes to saying things, the better off we will all be. If we were all the same and all had the same views, the world would be a pretty dull place.

Well, she's been dealt with and won't be a such a problem that blocking her won't fix.
On another note...i was stopped last night on my out for my break but he only did a plain view search of the back. It was a different guard this time and I was waiting for him to ask me to open up my truck box but he didn't. Just did a quick look around and said ok. I have no problem with that at all. They just don't need to be asking me to violate my rights and submit to a thourough serch. Might as well agree to a pad down which would constitute physical assault in my book.

Wwwwwwwweeeeeeeeeeellllllllllllllllllll.................................. Ok. Truthfully, I've missed it. I stepped back from here in what, November? Then in April I left "the other place" (couldn't bear to support the owner any more, and didn't like a lot of the changes with the influx of new people and "upstairs denizens" and the move to the new software) so except for the occasional blog comment, I've been off message boards all that time. Things here seem to have settled down nicely... I spent a lot of time this weekend reading relevant threads and Live Journals to get a grip on how things came down. I think the situation at the root of everything may have been resolved, so here I am, we'll see how it goes. Be warned tho..... if anyone starts any serious commotion, I will not be a passive victim, I will take steps! I was figuring I'd just hunt down the perpetrator and spank them, but I think there are those that would enjoy that too much. Instead, I will resort to something passed down in my family for generations, all the way back from my ancestors in the old country, far away. I will unleash upon the troublemaker the ancient evil stink eye!  Yes! A terrible weapon, but be warned.....trifle with the good karma of this community, and I will see that you bear the stench even unto your last day! Seriously for a second. I mention "the other place" for a reason. I invested three years and seven thousand posts there, but when I got my fill and quietly slipped away, nobody there (except Sithi! Thank you!) seemed to care or even notice. Here, on the other hand......well, suffice it to say that a lot of you have been pestering me to death (in a good way of course.....not that there's anything WRONG with that....) to return. Even though I may not have answered, I appreciate that, the PMs and the posts asking me to participate again, more than you can know. So, as the saying goes, be careful what you wish for, you may get it! I'm BACK baby!!!!

Again, I think it was because I was a semi popular guy over there that he got rid of me. Too much photo work being done of me and by me as well as Kris and Tral, as well as Kris' Shows that were much liked by the genpop that probably detracted from Leo's glory. It was just one day BOOM! Gone. No reason and no explaination. He had to make an example of someone to prove that he could excise anyone he wanted for no reason or logical explanation at all just to prove a point to everyone and keep them in line. Haven't been back since nor do I care to. I'm not one of those that have been banned 5 times and feel the need to appologize and beg to be let back in. I feel that I did nothing to appologize for and why would I want to belong to a place like that where Leo was so quick to slander me and make lies about me and the genpop were so quick to swallow those lies and forget about me? Begging to be a part of that is masochistic to say the least. This is a much better place, even though there are eruptions from time to time. They are quelled quickly without the needs for much banning.
